FDA has begun stopping ephedra salesHearing on ephedra ban: Judges seem behind ephedra banDENVER, May 9 taken from wire reports -- The U.S. Food and Drug Administration wants to overturn a judge's ruling to lift a ban on diet supplements that contain low doses of ephedra, a report said. The FDA argued Monday that U.S. District Judge Tena Campbell in Salt Lake City misunderstood the law in ruling last year that the ban could not be used on diet supplements that contain 10 milligrams or less of ephedra. FDA attorney Christine Kohl told a three-judge 10th U.S. Circuit Court of Appeals panel in Denver that the judge ignored scientific information on ephedra's effects and wrongly ruled the FDA had to prove harm, CBS News reported. Ephedra has been linked to dozens of deaths and thousands of reports of health problems. However, Jonathan Emord, an attorney for Nutraceutical Corp., argued that the FDA could ban any substance that could be harmful in large doses -- even vitamin C and peanut butter -- if the judge's ruling is overturned. The FDA based its ban in part on work by a doctor who studied the intake of various substances similar to ephedra rather than on use of ephedra itself.
